Defense Against Multiple DUI Offenses

People charged with a second or subsequent DUI are in a very serious predicament.  At this point prosecutors and law enforcement officers are going to do whatever it takes to ensure the strictest penalties are applied to your case.  In the eyes of the law, you’ve broken the law and risked the lives of innocent people not once, but at least twice.  This fact alone is enough to warrant intense criminal prosecution and harsh legal penalties.

If you are facing DUI charges for the second, third, fourth, or even the fifth time, it’s imperative that you speak with a skilled Orlando DUI attorney who has experience handling multiple DUI cases.  The attorney you hire must be familiar with aggressive defense strategies that have proven to be effective.  Without the proper defense representation, you could be subjected to the following penalties based on your prior DUI history:

2nd DUI:

  • Jail: 10 days to 12 months
  • Fines: $500-$2,000
  • Driver’s License Suspension: 180 days to 5 years
  • Probation: 1 year
  • Vehicle Impoundment: usually 30 days
  • Ignition Interlock Device: 1-2 years

3rd DUI:

  • Jail: 30 days to 5 years
  • Fines: $1,000-$5,000
  • Driver’s License Suspension: 180 days to 10 years
  • Probation: 1 to 5 years
  • Vehicle Impoundment: usually 90 days
  • Ignition Interlock Device: at least 2 years

4th DUI:

  • Jail: 1 to 5 years
  • Fines: $1,000-$5,000
  • Driver’s License Suspension: permanent
  • Probation: 1 to 5 years
  • Vehicle Impoundment:  you may be subjected to vehicle forfeiture
  • Ignition Interlock Device: at least 2 years (if the state has taken away your vehicle)

In addition to these legal penalties, points will also be added to your driving record, your car insurance will go up, and you’ll be required to attend DUI school and perform hours of community service.

If you were responsible for causing a DUI accident that led to the death or serious injury of another person, not only will you undoubtedly face enhanced penalties, but you will also likely be charged with additional offenses, such as aggravated assault, assault with a deadly weapon, or vehicular homicide/manslaughter.
