Racing on the highway is a first degree misdemeanor offense, punishable by $500-$1,000 in fines, driver’s license suspension for one year, and possibly up to one year in jail. Under Florida statute 316.191, a driver will be charged with racing on the highway if he or she:

  • Drives any type of motor vehicle (including a motorcycle) in a race, speed competition or contest, drag race or accelerated contest, test of physical endurance, or exhibition of speed or acceleration for the purpose of making a speed record on any highway, roadway, or parking lot;
  • Participates in, coordinates, facilitates, or collects money at any location for any such race, competition, test, or exhibition;
  • Knowingly rides as a passenger in any such race, competition, test, or exhibition; or
  • Purposefully stops or slows traffic for a race, competition, test, or exhibition
