Florida Underage DUI Law

Florida has a zero tolerance policy when it comes to underage drinking and driving.  Police officers have the right to arrest an underage driver and test their blood alcohol concentration if there’s probable cause to believe the driver may be under the influence.  If it is discovered that the driver has a BAC of .02 or more, he or she will face DUI charges.  If the charges lead to a conviction, the driver will get his or her license suspended based on the following criteria:

  • First Offense:  6 months driver’s license suspension
  • First Offense and BAC test refusal: 1 year driver’s license suspension
  • Second Offense:  18 month driver’s license suspension
  • If BAC was .05 or more: license suspension until the driver is 21 and has completed a substance abuse course.
